| Abelardo Soto is arrested by Miami Beach police on March 26. |
Soto's arrest along with that of a woman were caught on multiple videos that quickly went viral.
Here's the original account of Soto's arrest in the Miami Herald:
As Simon arrested Greenback, police say Abelardo Antonio Soto began throwing sand at Simon, and inciting the crowd.Tonight WSVN reports
An arrest report says Soto, of North Miami, “was able to turn the crowd hostile towards officers, as numerous people began fighting with officers.”
The report says that Simon approached Soto, who struck the officer with a weapon. Simon suffered a deep cut on his forehead and received stitches at Mount Sinai Medical Center, according to reports.
The videos, however, do not show if or when Simon was struck.
They do show Simon grab a man in a white shirt and Yankees hat and say “Now you and me go” before throwing him to the ground and handcuffing him.
Soto, 29, was arrested and charged with aggravated battery of a law enforcement officer, resisting an officer with violence, and affray.
Police initially said he injured the officer by hitting him with an unknown weapon. Soto's wife said she watched the video several times and found him to be innocent. "After I watched the video last night, it clearly showed that he didn't hit the officer. He was just an innocent victim," said Soto's wife, who wished to remain anonymous..
The video shows Soto getting involved in the arrest of the woman and saying something to the officers. Then, all of a sudden, you see a Miami Beach police officer take him to the ground.
Soto's attorney, Michael Joseph, said Miami Beach Police are trying to cover themselves. "I think they just made a mistake, and now they're just trying to cover themselves," said Joseph.
Miami Beach Police said the officer did nothing wrong. They said, it was not a case of excessive force, but a case where officers where outnumbered by an unruly and rowdy crowd.
As to Soto, MBP released a statement that read: "In the regular course of reviewing felony arrest, conducted by the state attorney's office, in cooperation with our police department, determinations are made as to the charges that frequently may involve the addition, modification or removal of any charges."
